Common Stock, $0.50 Par Value (the "Common Stock") Subject to the prior rights of the Series 1995 Preferred Stock and any other shares of Preferred stock that may be issued from time to time, and except as otherwise set forth below, the shares of Common Stock of Comstock Resources, Inc.
